1. DEFINITIONS
Customer
Refers to any natural or legal person who books a service via email, telephone, or the company’s online booking form. Upon delivery of the booking confirmation, the customer enters into a legally binding contractual relationship in accordance with the applicable GTC.
The customer:
• must be at least 18 years old and legally capable of entering into binding contracts;
• must not be subject to any legal restriction preventing the conclusion of a contract;
• is responsible for providing complete and accurate information during the booking process;
• is financially liable for all booked and/or provided services, including changes, cancellations, or surcharges;
• must ensure that all travelers are fully informed about the booking and any potential changes;
• confirms that all travelers accept these GTC.
Traveler
Refers to any person named in the booking confirmation who uses the transport service. A traveler may, but does not have to be, the customer. All travelers must be at least 18 years old or be accompanied by an adult and must comply with these GTC. Minors must provide consent from a parent or legal guardian.
Service (Transfer/Ride)
Refers to the agreed transportation of travelers by a licensed driver using a vehicle between a specified pickup and destination location.
Company / ABC Taxi & Transfer KG / we / us
Refers to ABC Taxi & Transfer KG. The company provides all services itself as a licensed passenger transport business and does not act merely as an intermediary.
Carrier / Partner
Refers to authorized subcontractors, if applicable, commissioned by ABC Taxi & Transfer KG to perform transfers when required. All carriers are legally registered and licensed passenger transport providers.
Confirmation
Refers to the formal booking document sent to the customer by email containing all relevant details from the booking form. The legally binding contractual relationship comes into effect upon delivery of the confirmation.
In the event of discrepancies between the terms of a subcontractor and these GTC, the provisions of these GTC shall prevail.

2. ABOUT US
ABC Taxi & Transfer KG is a commercial passenger transport company based in Innsbruck, Austria, providing airport transfers and similar transportation services.
We operate our own vehicles and are directly responsible for the performance of the services. Subcontractors are used only when necessary and remain under our responsibility.
By using our services, customers acknowledge that:
• they enter into a legally binding contract directly with ABC Taxi & Transfer KG;
• ABC Taxi & Transfer KG is responsible for the execution, quality, safety, and legality of the transfers;
• subcontractors are supervised by us and meet all legal requirements.

3. INTRODUCTORY NOTES / ACCEPTANCE OF TERMS
By completing the booking process, users confirm that:
• they are legally authorized to enter into binding contracts;
• they fully accept these GTC;
• the completed booking form forms an integral part of the contract.
Failure to accept the terms prevents a booking.

4. TYPE AND SCOPE OF SERVICES
The service includes the provision of a vehicle with a licensed driver for transport between a pickup and destination location.
Vehicle images, routes, and times are non-binding illustrations. Changes due to traffic, weather, or force majeure are possible.
Extras such as child seats, additional stops, or waiting time are optional and must be specified during booking.

5. BOOKING PROCESS
A booking becomes legally binding only upon delivery of the written confirmation.
All details must be carefully checked, including pickup time, flight numbers, and contact details.
We recommend arriving at the airport at least 2 hours before departure and planning an additional 20% buffer time for transfers.

6. EQUIPMENT & EXTRAS
• Child seats: Available upon request; no liability for special requirements.
• Equipment: Skis, snowboards, wheelchairs must be declared during booking.
• Additional stops: Only possible with prior booking or driver approval; additional charges may apply.
• Meet & Greet: Included.
Tips are voluntary.

7. LUGGAGE POLICY
Standard allowance per seat:
• 1 medium-sized suitcase
• 1 piece of hand luggage
Vehicle capacity must not be exceeded. Additional travelers or luggage may result in price adjustments.

8. WAITING TIME
Free waiting time:
• Airports: 60 minutes from landing time
• Other locations: 30 minutes from the agreed pickup time
Additional waiting time available upon request.
Every additional 15 minutes: EUR 17.50

9. PAYMENT METHODS
Accepted payment methods: credit card, cash, bank transfer.

10. CANCELLATION
By the customer:
• up to 24 hours before pickup: 100% refund
By ABC Taxi & Transfer KG:
• full refund in case of cancellation.

11. CHANGES, ADJUSTMENTS, AND CANCELLATIONS
ABC Taxi & Transfer KG reserves the right to propose changes to booking details if required for service quality or organizational reasons, including adjustments to pickup time, payment method, or other relevant details. Acceptance of proposed changes is not mandatory. If rejected, the original booking details remain valid.
Incorrect or incomplete information (e.g. number of travelers, luggage volume, pricing errors) will be reported for correction. If this results in a price change, the corrected price will be submitted for approval. If rejected, the booking may be canceled under the standard cancellation conditions (Section 10).

12. TRAVELER NO-SHOW POLICY
A “customer no-show” occurs if a traveler does not appear at the confirmed pickup location at the agreed time and cannot be reached during the included waiting period.
• The pickup location is deemed official.
• For flight, bus, or train transfers, arrival data is monitored and alternative meeting points may be offered.
• Customer service must be contacted at least once, and the customer must be reachable at the provided phone number.
• If unreachable, this is considered a customer no-show; no refund applies.
• The same rules apply to return transfers if no confirmation is received 24 hours in advance.

13. DRIVER NO-SHOW POLICY
The driver must arrive at the pickup location at the agreed time. Delays of up to 15 minutes will be communicated via SMS; otherwise, phone contact will be attempted.
If it is proven that both driver and traveler were present but the transfer was not carried out, ABC Taxi & Transfer KG will investigate and inform the customer within 30 business days.

14. FORCE MAJEURE
Extraordinary, unforeseeable events beyond the control of ABC Taxi & Transfer KG (natural disasters, strikes, pandemics, military conflicts, etc.) suspend contractual obligations. ABC Taxi & Transfer KG is not liable for non-performance or delays. Reasonable efforts will be made to inform customers and offer alternative solutions.

15. TRAVELER CONDUCT
ABC Taxi & Transfer KG may refuse, interrupt, or cancel services if a traveler’s behavior:
• is unsafe or irresponsible;
• causes inconvenience, stress, or danger;
• violates laws, public order, or contractual obligations;
• involves alcohol, drugs, or medication impairment;
• involves weapons or dangerous objects;
• is threatening, abusive, or violent.
No refunds apply; damages must be fully compensated.

16. ACCEPTANCE OF RISK
By using the services, you accept the inherent risks of travel, including delays, accidents, or unforeseeable events. You agree to follow safety instructions and confirm that you are fit to travel. Travel insurance is recommended.

17. DISPUTES AND LIABILITY
• Complaints must be submitted within 10 days; processing within 30 days.
• Liability is limited to direct damages under the control of ABC Taxi & Transfer KG.
• Place of jurisdiction: Innsbruck, Austria; Austrian law applies.

18. COPYRIGHTS AND INTELLECTUAL PROPERTY RIGHTS
All content on our websites and booking platforms, including but not limited to texts, layout, trademarks, logos, graphics, images, videos, databases, and software, is the exclusive property of ABC Taxi & Transfer KG or its licensed partners.
Any copying, reproduction, modification, distribution, public display, transmission, linking, or other use beyond service utilization—including commercial use, competitive analysis, scraping, deep linking, or data mining—without prior written consent is strictly prohibited and may result in legal action and claims for damages.

19. SUBJECT AND DURATION OF THE AGREEMENT
These provisions govern the processing of personal data within the scope of the GTC (“Agreement”) between ABC Taxi & Transfer KG and the customer. Unless otherwise defined, terms correspond to Articles 1, 3, and 17 of these GTC.
Under the GDPR (Regulation (EU) 2016/679), particularly Article 54, ABC Taxi & Transfer KG acts as the data controller. This Agreement remains valid for the duration of the GTC.

20. TYPE, PURPOSE, AND SCOPE OF PROCESSING
Personal data provided during booking and subsequent communication are processed exclusively to handle inquiries and perform the agreed transfer services.
Processing occurs within the EU/EEA. Transfers to third countries take place only in compliance with GDPR Articles 44 et seq. and with our consent.
Electronic communications may include:
• booking confirmation
• booking modifications
• invoices
• service review invitations for internal quality purposes
Telephone contact is limited to proper service provision; any further communication requires consent.

21. TYPES OF PERSONAL DATA
Processed data includes:
• booking details (date, time, pickup and destination, flight/train/ferry numbers);
• number of travelers and luggage;
• contact details (name, phone number, email);
• vehicle category, child seats, special requests;
• meeting point information and driver communication;
• post-booking changes or additions.
Retention: certain personal data is stored for 11 years in accordance with legal requirements.

22. RIGHTS AND OBLIGATIONS OF ABC TAXI & TRANSFER KG
ABC Taxi & Transfer KG undertakes to:
• process personal data in compliance with GDPR and national data protection laws;
• ensure auditors or inspectors are bound by confidentiality;
• promptly process requests for data subject rights;
• retain required consents or authorizations (e.g. parental consent for minors).
Legal provisions may require longer retention or disclosure to authorities.
Data is shared with partners solely for service provision and in compliance with legal requirements.

23. RIGHTS OF DATA SUBJECTS
Under GDPR, you have the right to:
• information about stored personal data and processing purposes;
• access to your personal data;
• rectification of inaccurate data;
• erasure, where no statutory retention obligations apply;
• restriction of processing;

• objection to processing;
• rights related to automated decision-making (currently none).

Requests are processed within 30 days; complex cases may extend to 60 days. A reasonable administrative fee may apply for excessively complex requests.

24. FINAL PROVISIONS
• Amendments to the GTC take effect upon publication on the website.
• Existing bookings remain unaffected.
• Invalid clauses shall be replaced by legally permissible provisions.
